32 <P>The requested amendment has been granted under the authority of the Endangered Species Act of 1973, as amended (ESA; 16 U.S.C. 1531<E T="03">et seq.</E>) and the provisions of 50 CFR 222.306 of the regulations governing the taking, importing, and exporting of endangered and threatened fish and wildlife (50 CFR 222-226).</P>

34 <P>The modification extends the expiration date of the Permit from March 31, 2004, to March 31, 2005, for takes of green (<E T="03">Chelonia mydas</E>), loggerhead (<E T="03">Caretta caretta</E>), leatherback (<E T="03">Dermochelys coriacea</E>), hawksbill (<E T="03">Eretmochelys imbricata</E>) and olive ridley (<E T="03">Lepidochelys olivacea</E>) sea turtles.</P>
35 <P>Issuance of this amendment, as required by the ESA was based on a finding that such permit: (1) Was applied for in good faith; (2) will not operate to the disadvantage of the threatened and endangered species which are the subject of this permit; and (3) is consistent with the purposes and policies set forth in section 2 of the ESA.</P>
