36 <p type="1">The subject application and permit amendments are requested
37 under the authority of the Marine Mammal Protection Act of 1972, as
38 amended (MMPA; 16 U.S.C. 1361 et seq .), the Regulations Governing
39 the Taking and Importing of Marine Mammals (50 CFR part 216), the
40 Endangered Species Act of 1973, as amended (ESA; 16 U.S.C. 1531 et
41 seq .), the regulations governing the taking, importing, and
42 exporting of endangered and threatened species (50 CFR 222-226), and
43 the Fur Seal Act of 1966, as amended (16 U.S.C. 1151 et seq. )</p>
44 <p type="2">New Application Received</p>
45 <p type="1">For Application No. 715-1614-00, the applicant requests
46 permission to conduct vessel and aerial surveys, collect tissue
47 samples (sloughed skin and skin and blubber biopsies) from living,
48 free-ranging animals and collect skin, blubber, blood, bone, baleen
49 and other organ tissue samples from dead stranded animals from all
50 age and sex classes of 21 cetacean species in U.S., foreign, and
51 international waters. Tissue samples would be used to quantify
52 toxicant loads and immunochemical responses to these loads to test
53 the hypothesis that there are demonstrable differences between
54 different populations ans species with regard to the levels of toxic
55 compounds present. Genetic analyses would also be performed on
56 samples to investigate the genetic diversity and variability of the
57 population groups sampled. This information would be used to
58 establish a baseline for comparisons with future samples and to
59 assist in making future management and conservation policies.</p>
60 <p type="2">Permit Amendment Requests Received</p>
61 <p type="1">
62 For Permit No. 782-1532-00, the Permit authorizes the Holder to take
63 Steller sea lions (
64 <species_scientific name="Eumetopias jubatus">Eumetopias jubatus
65 </species_scientific>
66 ) for research that involves takes by aerial and ship based surveys
67 biennally, capture and take morphological measurements, collect
68 specimens (blood and biopsy), brand, tag, and disturb during scat
69 collection. The Holder now requests to amend the take authority to
70 conduct aerial surveys each year, include Southeast Alaska in
71 monthly surveys, increase the number of animals to be incidentally
72 harassed during scat collection, allow additional procedures for
73 animal handling such as: using gas anesthesia, branding pups ≥4 mos
74 and juveniles to 3 yrs, injecting Evan’s blue dye and deuterated
75 water, collecting muscle biopsy, using noninvasive bioelectric
76 impedance analysis, increasing blood sample volume, extracting a
77 tooth, and pulling vibrissae. This Permit amendment will improve
78 field techniques and incorporate collaborative efforts of scientists
79 funded under the Steller Sea Lion Research Initiative.

82 For Permit No. 981-1578-00, the Permit authorizes the Holder to tag
83 cetaceans with an advanced digital sound recording tag (DTAG) that
84 can record the acoustic stimuli an animal hears, along with
85 measuring vocal, behavioral, and physiological responses to sound
86 played back at received levels of 120-160 dB re 1 micron Pa. The
87 research was authorized in the Mediterranean and Ligurian Seas and
88 off the coast of the Azores in the North Atlantic. The Holder
89 requests an amendment to increase the source level but not the
90 received level for a whale-finding sonar to 200 dB re 1 micron

93 at 1 m, add playbacks involving exposure to impulse signals from
94 airguns as used in seismic surveys, include one additional baleen
95 whale species and 12 species of Odontocete whale, and extend the
96 study area to include North Atlantic and Gulf of Mexico.

98 <p type="1">In compliance with the National Environmental Policy Act of
99 1969 (42 U.S.C. 4321 et seq .), an initial determination has been
100 made that the activities proposed are categorically excluded from
101 the requirement to prepare an environmental assessment or
102 environmental impact statement.</p>
103 <p type="1">Written comments or requests for a public hearing on the
104 application or amendment requests should be mailed to the Chief,
105 Permits and Documentation Division, F/PR1, Office of Protected
